Assumption of Risk, Release of Liability, Waiver, and Photo and Video Release

Please read this carefully. It affects your legal rights. To RSVP for Rally for Recovery you must agree to it.

1. The activity and its risks

The event includes pickleball and other physical activity. These activities carry risks that cannot be removed completely, including slips, trips and falls; being struck by a ball, paddle or another person; sprains, strains, fractures and other injuries; heat-related illness and dehydration; heart and other medical events; and, in rare cases, serious injury or death. Risks can also come from the actions of other guests, the condition of the courts and grounds, the weather, and food or drink served at the event.

2. Your participation is voluntary

You choose whether to attend and whether to play. You are responsible for deciding whether you are fit to take part, for playing within your ability, and for stopping if you feel unwell. You confirm that you have no medical condition that makes taking part unsafe for you, or that you have checked with a doctor.

3. Assumption of risk

You understand the risks described above, including risks that are not listed, and you voluntarily accept all of them.

4. Release and waiver

To the fullest extent permitted by law, you release, waive and agree not to sue Graxe.ai, Inc. and its officers, directors, employees, contractors and volunteers, and Recovery Outside and its officers, directors, employees and volunteers (the "Released Parties"), for any injury, illness, death, or loss of or damage to property that arises from or relates to your attendance at or participation in the event, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY RELEASED PARTY.

This release does not apply to gross negligence or intentional misconduct, or to any right that cannot be waived under Texas law.

5. Medical care

If you are injured or become ill, you authorize event staff and volunteers to call for emergency medical help on your behalf. You are responsible for the cost of any medical care you receive.

6. The venue's waiver is separate and required

Austin Pickle Ranch requires every player to create an account and sign its own liability waiver before playing. You must sign it online in advance. We send you the link to the Austin Pickle Ranch event page as soon as you RSVP on graxe.ai/radiate. This release does not replace the venue's waiver, and the venue's waiver does not replace this release.

7. Guests under 18

Guests under 18 may take part only with a parent or legal guardian present, who must accept this release and sign the venue's waiver on the minor's behalf.

8. Photography and filming

The event will be photographed and filmed by Graxe.ai, Inc., Recovery Outside, and people working with them. By attending, you agree that you may appear in photographs, video and audio recordings made at the event. You give Graxe.ai, Inc. and Recovery Outside permission to use those recordings, including your image, likeness, voice and any name you give us, in any media (websites, social media, email, advertising, press and fundraising), anywhere in the world, without payment and without needing your further approval. To the fullest extent permitted by law, you give up any claim for invasion of privacy, right of publicity or defamation arising from that use.

You can opt out. Recovery is personal. If you would rather not appear, tell the team at check-in and you will receive a marker that asks our photographers not to feature you. After the event, you can email community@graxe.ai and we will stop using images of you in anything we publish from then on, where that is reasonably possible.

We will never describe any guest as being in recovery, or share anything about a guest's health, without that person's written permission.

9. General

This release is governed by the laws of the State of Texas. If any part of it is found unenforceable, the rest remains in effect. It applies to you, your heirs, executors and anyone who might bring a claim on your behalf.

10. Your agreement

By ticking the release box on the RSVP form, you confirm that you are 18 or older (or a parent or guardian accepting for a minor), that you have read this release, including the photo and video release in section 8, that you understand you are giving up legal rights, and that you agree to it voluntarily. We keep a record of the version you agreed to and the time you agreed.
